Clerk Confirms that Candidates Are Living in the County

County Clerk confirms that Robbie Sharp and Tanner Graham are living in the county.  Both candidates showed up at the courthouse and brought evidence that they are still living in the county.  Apparently,  Tanner misstated that he was living in Charleston.  Robbie's fulltime job in another state doesn't mean that he doesn't live here.

Apparently, the 900 mile trip on the weekends is possible despite the public's perception that he actually loves in Georgia.  Tanner is an employee of the Dept of Ag in Charleston but still claims to live in Pocahontas County.  It is only a 2.5 hour trip home.

The two candidates presented evidence of their living location to Clerk Missy Bennett.  They showed her their driver's license which according to state law confirms that they are still living in Pocahontas County.

It appears that they are bonafide residents of Pocahontas County just like Farm Commissioner Walt Helmickis a bonafide farmer.

WV Voter Eligibility Requirements

Before you head out to register, make sure you are eligible to vote in West Virginia first. You must:
  • Be a United States citizen AND reside in West Virginia.
  • Not be deemed "mentally incompetent" by the court.
  • Not be currently convicted for a felony (including for treason and election bribery), on probation, or on parole.
  • You must be 18 years old or older before the general election or special election.

Renew Your WV Driver's License

Military personnel: Please refer to the “Military Out-of-State Renewals in West Virginia" section below.
You must renew your WV driver's license in person at your localWest Virginia DMV office. You cannot renew onlineby phone, or by mail. The WV DMV does NOT accept appointments for driver's license renewals.
NOTE: If you're temporarily outside of West Virginia and need to renew your WV driver's license, you should contact the WV DMV at (800) 642-9066 to find out if you're eligible to renew while out of state.
To renew, you will need:
  • A completed Application for a Driver’s License or Photo ID Card (Form DMV-DS-23P).
  • 1 document proving your identity, such as your:
    • U.S. birth certificate (original or certified copy).
    • Valid U.S. passport.
    • Certificate of Naturalization issued by the DHS.
  • 1 document to prove your Social Security number (SSN), such as your:
    • Social Security card.
    • Original W-2 form.
      • You may use the same W-2 form as 1 document to prove your residency if no more than 18 months old.
    • 1099 form with your SSN and name.
  • Either:
    • 2 documents from “List B" to prove your residency (must not be more than 60 days old), such as your:
      • Utility bill.
      • Valid WV registration card.
      • Lease agreement.
      OR
    • 1 document from each “List B" and “List C", such as your:
      • WV auto insurance card.
      • WV bank statement.
      • WV driver's license renewal letter.
  • Payment for the renewal fee (see “Fees to Renew Your WV Driver's License" below).
The WV DMV provides a complete list of identification documents (“List B" & “List C").
NOTE: If the WV DMV already has your scanned documents on file (and you have not changed your address or name), you must only bring 2 documents to prove your residency in West Virginia.

REAL ID-Compliant Driver's License

The WV DMV complies with the REAL ID act in order to meet federal requirements. To become Real ID compliant, you must bring a series of identification documents to your local WV DMV driver license office when you go to renew your WV driver's license.
When you visit the WV DMV in person to renew your WV driver's license, you will have the option to obtain a card for “Federal Identification Use" or “Not for Federal Identification Use."
If you choose to receive a driver's license for “ Federal Identification Use," you will receive a temporary card valid for 60 days to use until your federal-use WV driver's license arrives within 15 business days. Your card will show a gold star on the face of the card.
NOTE: All proof of identification documents you submit will be scanned and returned before you leave your local WV DMV office.

Non-U.S. Citizens

If you're a non-U.S. citizen and would like to renew your WV driver's license, you must visit your local WV DMV officeand provide the following documents in addition to the above:
  • 1 document to prove your legal U.S. presence, such as your:
    • INS form I-551 Alien Registration receipt card.
    • I-551 stamp on your foreign passport or I-94 card/number.
    • Re-entries permit I-327.
  • 2 documents to prove your WV residency, such as your:
    • Utility bill.
    • Valid WV registration card.
    • Lease agreement.
§3-2-28. Challenges; notice; cancellation of registration.
(a) The registration of any registered voter may be challenged by the clerk of the county commission, the secretary of state, any registrar of the county, the chairman of any political party committee or by any voter who shall appear in person at the clerk's office. The person challenging the registration shall complete a form prescribed by the secretary of state giving the name and address of the voter and the reason for challenge. The challenge shall be filed as a matter of record in the office of the clerk of the county commission.

(b) Upon the receipt of a challenge, the clerk of the county commission shall mail a notice of challenge to the registrant, setting forth that the voter's registration will be canceled if the voter does not appear in person during business hours at the clerk's office within a period of thirty days from the mailing of the notice and present evidence of his or her eligibility. The form of the notice of challenge shall be prescribed by the secretary of state and shall be mailed by certified mail, return receipt requested.

(c) If the notice of challenge is returned as undeliverable at the registration address, or if the challenged registrant does not appear and present evidence of continued eligibility within the prescribed time, the voter's registration shall be immediately canceled. Returned mail or failure to appear shall be prima facie evidence of the registrant's ineligibility. If the registrant does timely appear and present evidence of his or her eligibility, the clerk shall determine eligibility to be registered as a voter as in any other case. If the reason for ineligibility is that the voter does not reside at the address on the registration and the voter presents evidence of residence elsewhere in the county, the clerk of the county commission shall accept a request for change of address and remove the challenge.

  4. Odd he lives here but his mail was postmarked in Georgia on the 31 first.How can that be. And if he has a full time job there is he driving back and forth every day to work.i winder where his tax returns were filed. I wonder if georgia considers him a resident and requires him to have a drivers license there legally.

  6. This is laughable. If someone working full time in Georgia can still be a county resident, then the residency requirement is absolutely meaningless. Any competent judge would say so too.

  7. Odd how all of his freinds on face book who live in good old corruption infected pc miss him . normally when you miss people its indications they no longer live around them. AND HE WAS modeling underwear for Georgia while his friends and West Virginia said they missed him. It seems like the only people who buy his story are in the courthouse and his dingleberry friend who keeps making comments here. I like how the dingleberry keeps bragging and thanks it's all done and over. Water for the dingleberry is he hasn't got a clue about what's is about to happen next.

  9. Missy should go knock on thier doors every day and see if they are home. Big suprize. The drivers license means nothing if your dishonest and fail to get another one when you move.
