Magistrate Wilfong to Reconsider Ruling on Property Rights.


Local MacGyver and metal worker, John Leyzorek, may have a second shot with Magistrate Carrie Wilfong who ruled against him on all his property rights motions at the first year.  She has graciously rescheduled a hearing on motions for Friday at 2:00.  

This is to be combined with Assistant Prosecutor Bob Martin motion to gag John and prevent him from conveying information about his case to the Pocahontas Commentator and editor Norman Alderman.  


Martin has accused John of using the Internet to poison the minds of a prospective jury.  



Alderman is prepared to testify at the hearing that his publication of John's motion were done at his (Alderman's) instigation.  Alderman regularly gleans the courthouse records room and the Internet for criminal and civil records.  These have become one of the most interesting features of the Commentator and are read avidly by hundreds of readers both in and outside Pocahontas County.

Alderman currently has a lawsuit for violation of his 4th Amendment Rights in Federal court.  He is not on several Christmas card mailings in the courthouse.  



Because these are public documents it is not lawfully possible to restrict their publication on the Internet.  Alderman has invited the reporter for the Pocahontas Times to be present at the hearing because the results of that hearing could impact the reporting ability of the Times.


John Leyzorek is president of the Pocahontas County Concerned Citizens group which opposes zoning and has been a force to be reckoned with since the early 70's under Gilbert Jack of Marlinton who led a successful battle against government regulation that has never suffered a defeat in 40 years. 



John is a Libertarian in philosophy which basically means that he opposes government intervention in the affairs of citizens particularly as they relate to property rights and the 4th Amendment.



John was originally cited by Department of Highway officers who attempted to enter his property with an improper warrant.   They had received a complaint from an anonymous person that he was operating a salvage yard without a license. 


John is a well-known metal worker and restorer of antique vehicles.  He is known for his ancient tractor and truck which he has used in various parades to pull the historical society float.  Local farmers often call upon John to fix their "no so new" farm machinery.  He is something of a "MacGyver   " minus duck tape.


The Department of Highways originally offered to leave John alone if he would apply for a salvage license. 


He refused because he is a restorer of old vehicles and antique machinery.  His goal is to archive antique parts in anticipation of usefulness in the future. 


 His farm is like a living museum of iron or an "old age home" for antique parts.  Only in his case some of those exhibits may be called back to "active duty" if a John or a neighbor needs a piece of farm equipment restored.



His farm is over a mile off the Back Mtn road huddled up against the mountain.  U.S. 219 is several miles away.  No one can see his farm from the road.  In fact, when the officers came to his farm they had only an anonymous complaint and a satellite photo someone had "googled" from Google Earth.  They apparently knew that this was insufficient for "probable cause to search his farm."


So they added a third element to their citation, "that he refused to let them come on his property."  Essentially, he is being charged with refusing to let an officer(s) of the law enter his property to see if he is breaking the law.  John contends that he should not be accused of exercising his 4th amendment rights by forbidding trespass on his property.



Assistant Prosecutor Bob Martin claims that officers have an absolute right to search a person's property.  John disagrees except that they can only enter with a proper search warrant and that an anonymous complaint and a copy of satellite photo are not sufficient reason to subject his farm to a search.  No warrant, no search.


This citation is particularly egregious in that the officers had to drive past a huge junkyard a mile or so from Marlinton right beside U.S. 219 to get to his farm.  



Apparently, someone who didn't like John decided to "turn him in." This citation could have cost John a lot of money to fight had he had to pay a lawyer.  Fortunately,  John is a student of the law and is quite proficient in defending himself in local court.



So Friday will be a very interesting day.  You won't want to miss a minutes of it at 2:00 downstairs in the court house magistrate's hearing room.

    Cops should not have a green light to produce frivolous search warrants, highway departments should not have a green light to spy on people's properties and define their possessions as "junk", and lawyers should not have a green light to "gag" public information.

    a typical salvage yard it is not.
    farmers and collectors of antique equipment have a right to do that as long as it's not an eye sore from the road.
    a salvage yard is open to the public. usually a salvage yard has advertisement a part warehouse a phone number in the phone book that shows that they are a salvage yard. I don't think John has any of that. Stalin Adolf Hitler and Mu would be proud of how Pocahontas County is run.

  4. Places like this may not be in sight of anyone but anytime old equipment, automobiles and machinery are being stored they still should be licensed so that proper regulation can take place. What if a gas tank on an old tractor leaked gasoline and contaminated the neighbors spring. We all have seen the results of contaminated water recently and although John's scrap pile is hardly capable of the contamination in Charleston, if you are the neighbor with the contaminated spring it is just as serious.

  7. He is using parts from the old equipment he has stored to fix and repair other equipment, isn't that exactly what a salvage yard is used for. At least it was before the price of scrap metal became so high that people just scrap old parts. I commend him for saving this old equipment but let's call it what it is. It is a salvage yard and should be treated and regulated as such.

  8. Let me get this straight, you think one man should be able to have junk around and not be bothered but another man shouldn't let a 256 ft cell tower be built. Are you for zoning or against it? You can't be for property rights only when it is something you want and believe in. You are for them all the time or not at all.

      what the people need to be asking is............who paid for the legal advice of bobby?.......and was it a dereliction of duty of the sheriff in doing so?
      these are the questions our good county commission should be asking and investigating.

      the proper protocol is the police conduct the investigations and make the arrests, the police coordinate with the LOCAL prosecuting attorney for the legal specifics of the case to deem if charges are warranted, is the evidence legit, acquired properly, etc.

      last time I checked, bobby was in private practice on the other side of the state when he was providing 'airtight' guidance to the good sheriff in the loco poco forest.
      guess he was scheming his retirement planning and return to the mothership of the dark poco forest.

      now that bobby has weaseled and mole holed his way into the prosecutors office (after a failed bid to properly win the election), the good sheriff now needs to jump the shark and go over his head and look for another litigating schmuck to do the charleston choo choo for his illegal antics.

  11. i never saw this guys place but,if there is any way he could straighten up a little maybe he should........it is a little hard to get upset about what meck is doing in greenbank and then defend some one who has an eyesore in edray.............that could be just as offensive as some ones right to have junked cars ,and old washers and dryers piled around an old beat mobile home......it might be their right ,but it still looks bad and it sucks..........this world is a gift that we should take care of and not trash,even if you can not see the trash from 219.............it is a a shame that we can not see eye to eye with the jerks in the court house,on any issue.................although i do not agree with how runny muck and beer can handled this,just more over kill,is all it is..........

  12. here's a novel concept - whenever these buttweasels raise their heads and cause trouble, the citizens need to start posting their case files on the commentator with "the fat man".
    bobby boy & co will have to have a hearing for each and every case........each on its individual merits........to be banned from being posted on the commentator.

    geriatric gene & bourgeoisie bobby can piss away their entire budget in situations where nobody wins and everybody loses.....especially justice and the taxpayers.
    come election time, the citizens will be so pissed off these clowns will have a one way ticket back to sleazing it up in private practice again.
    hopefully geriatric gene can provide legal guidance and instruction for bobby to successfully lose his law license multiple times.

  14. If a man is keeping salvage (even for later use) he should have a salvage license, period. I agree that he is not the only one and should not be singled out. There are numerous places in the county just as guilty and they should be gone after also.

  16. Everybody is entitled to an opinion about how other people should live.........but should they be able to enforce it?
    A person who actually harms others should be held to account. Perhaps if someone is doing something obviously, provably likely to harm others, he should be stopped before it happens. But this is a slippery slope for freedom. HOW likely must the harm be? WHO gets to decide?

    So we have laws, lots of 'em, that try to strike this balance. The laws defining salvage yards are so vague that Mitchell Chevrolet "is" one. The laws also say that the REASON for regulating them is to protect the pretty view from the highway, and that those same laws apply on and adjacent to the highway. Makes sense to me. Supposedly, Lazorek is a mile from the road. Sounds like Carrie did the right think to drop the bullsh!t case.

      sport some dark shades, buy a white stick with a red tip, buy a leash and bobby is in business.

  22. The law,used a,sat photo as proff yet they had,a victim tell them about totten and had been told,about his behavior from others and still couldn't gather enough evidence to charge him.
